1. Purpose, Agreement, and Relationship to Other CARMEPX Terms

This Inspection Disclaimer explains the nature, purpose, limitations, and permitted use of a CARMEPX vehicle inspection and inspection report. “Client,” “you,” and “your” mean the person who purchases, requests, receives, or uses the inspection service or report. “Vehicle” means the vehicle identified in the booking. “Inspector” means a person assigned by CARMEPX to perform or assist with the inspection. “Report” includes the written, electronic, photographic, video, diagnostic, or other inspection output issued by CARMEPX.

This Disclaimer applies to CARMEPX only. It supplements and is incorporated into the CARMEPX Vehicle Inspection Terms of Service. The Terms of Service govern booking, payment, refunds, liability limits, dispute resolution, arbitration, and other contractual matters. If this Disclaimer directly conflicts with the Terms of Service, the Terms of Service control unless applicable law requires otherwise.

2. The Snapshot Rule

A CARMEPX inspection is a time-limited evaluation of the Vehicle’s apparent condition at the specific date, time, location, recorded mileage, weather condition, operating state, and level of access existing during the inspection. The Report reflects observations and professional opinions based on what was reasonably visible, accessible, testable, and authorized at that moment.

Vehicle conditions can change immediately after an inspection because of continued use, movement, collision, storage, weather, repairs, tampering, seller activity, fluid loss, battery discharge, overheating, misuse, deterioration, or sudden component failure. The Report must not be interpreted as a permanent certification of condition.

3. Purchased Package Controls the Inspection

The inspection includes only the observations, checks, scans, photographs, tests, and deliverables expressly identified in the inspection package purchased by the Client. Sample reports, advertisements, training materials, website summaries, prior inspections, or general references to a “multi-point,” “comprehensive,” or “150-point” inspection do not expand the purchased package.

A listed point may be marked “Not Inspected,” “Not Accessible,” “Not Tested,” “Not Applicable,” “Unable to Verify,” “Restricted,” or similar wording when the item cannot reasonably or safely be completed. Such a status is not a pass, approval, or representation that the item is free from defects.

4. Non-Invasive Inspection and Physical Limitations

Unless the purchased package expressly states otherwise, CARMEPX inspections are non-invasive and do not include:

• Disassembling engines, transmissions, braking systems, steering systems, electrical systems, dashboards, body panels, interiors, or other vehicle components.
• Removing cylinder heads, spark plugs, injectors, fuel components, exhaust components, carpeting, seats, trim panels, permanently installed coverings, or sealed parts.
• Removing paint, wraps, body filler, sealant, undercoating, rustproofing, adhesives, or cosmetic repairs.
• Performing destructive testing, laboratory testing, fluid analysis, compression testing, leak-down testing, alignment measurement, emissions testing, or internal mechanical teardown.
• Placing the Vehicle on a professional shop lift or service pit unless that service is specifically included and safe access is available.
• Using manufacturer-authorized diagnostic equipment, proprietary software, specialized calibration tools, or equipment not stated in the purchased package.

The underside, internal components, concealed structural areas, and other inaccessible locations may not be fully visible. Dirt, snow, ice, water, oil, undercoating, body repairs, shields, covers, low ground clearance, lighting, or parking position may further restrict observations.

5. Hidden, Latent, Intermittent, and Concealed Conditions

CARMEPX does not guarantee detection of hidden, latent, concealed, inaccessible, intermittent, developing, temporarily corrected, recently cleared, or intentionally masked defects. A seller or prior owner may use cosmetic repairs, additives, code clearing, battery disconnection, warning-light modification, sealants, fresh fluids, cleaning, temporary adjustments, or other methods that reduce or remove visible symptoms during the inspection.

Some defects appear only under specific temperatures, loads, speeds, road surfaces, fuel levels, driving durations, weather conditions, or repeated operating cycles. A condition that does not occur during the inspection may not be discoverable.

6. Diagnostic Scan and Electronic-System Limitations

When included and authorized, CARMEPX may perform an electronic or OBD diagnostic scan. A diagnostic scan is a limited reading of data made available by the Vehicle and the equipment at that time. It is not a complete diagnosis, repair verification, manufacturer certification, software audit, or guarantee that every module has been accessed.

• Diagnostic trouble codes may have been recently erased, reset, suppressed, or prevented from appearing.
• A battery disconnection, repair, software update, or incomplete drive cycle may affect readiness monitors and stored data.
• Some modules, manufacturer-specific systems, pending faults, network faults, historical events, or proprietary data may be inaccessible to general scan equipment.
• The absence of a code, warning light, or readiness issue does not prove that the Vehicle has no mechanical, electrical, electronic, emissions, structural, flood, collision, or intermittent defect.
• CARMEPX does not program, calibrate, reflash, modify, repair, or guarantee vehicle computer systems as part of a standard inspection.

7. Road-Test Limitations

A road test is not guaranteed. It may be performed only when included in the purchased package, authorized by the owner or Seller, permitted by the location, and considered reasonably safe by the Inspector. The Vehicle must have appropriate keys, fuel, registration or lawful operating authority, and any required insurance or permission.

CARMEPX may decline, shorten, restrict, or immediately end a road test because of:

• Unsafe Vehicle condition, warning lights, overheating, fluid loss, tire condition, brake concerns, steering concerns, unusual noise, smoke, odor, or mechanical symptoms.
• Seller, dealership, property, insurance, registration, or legal restrictions.
• Severe weather, darkness, traffic, road closures, unsafe routes, parking limitations, or other environmental conditions.
• The Inspector’s reasonable safety judgment or lack of permission.

If no road test is performed, CARMEPX provides no opinion regarding conditions that could reasonably be detected only while driving. A short or low-speed road test may not reveal problems that occur only at highway speed, under heavy acceleration, during extended driving, while towing, or under other specialized conditions.

8. Safety, Roadworthiness, Emissions, and Recall Limitations

Unless CARMEPX expressly states otherwise in the purchased package, the inspection is not a government safety inspection, state inspection, emissions test, roadworthiness certification, recall clearance, repair authorization, or legal-compliance certification. A condition described as “acceptable,” “operational,” “good,” “pass,” or similar wording does not guarantee compliance with every law, regulation, manufacturer standard, insurance requirement, or safety standard.

CARMEPX may identify apparent safety concerns, but it does not guarantee that every safety defect will be detected. The Client should independently verify open safety recalls using an official government recall service and should obtain immediate diagnosis from an appropriate repair facility when a warning light, serious defect, unsafe symptom, or manufacturer “do not drive” instruction exists.

A Vehicle that may be unsafe should not be driven solely because a CARMEPX report did not identify the condition. The Client is responsible for arranging towing, further diagnosis, or repair when safety is uncertain.

9. Title, History, Odometer, Theft, Flood, and Seller Information

Unless specifically included in the purchased package, CARMEPX does not verify legal ownership, liens, title branding, theft status, odometer legality, accident-history database completeness, flood history, salvage history, lemon-law status, recall completion, maintenance-record authenticity, VIN authenticity, registration eligibility, Seller identity, or the accuracy of Seller statements.

Vehicle-history databases, title records, recall records, repair records, and Seller-provided documents may be incomplete, delayed, inaccurate, or unavailable. CARMEPX is not responsible for third-party database errors, missing events, false Seller statements, altered records, or undisclosed history.

10. Measurements, Estimates, Photographs, and Condition Ratings

Measurements, tread readings, fluid observations, scan results, repair-cost references, remaining-life estimates, and similar information are approximate unless the Report expressly states a verified test method. Repair costs vary by location, labor rate, parts availability, diagnostic findings, repair facility, taxes, and additional damage discovered during repair.

Photographs and videos may be affected by lighting, camera angle, image compression, weather, dirt, glare, shadows, screen settings, and access. They are supporting documentation and do not show every surface, defect, or surrounding condition.

Terms such as “good,” “fair,” “poor,” “acceptable,” “attention needed,” “recommended,” “not recommended,” “pass,” “fail,” or similar ratings represent limited observations or internal report classifications. They are not warranties, guarantees, appraisals, promises of remaining useful life, or instructions to purchase or reject the Vehicle.

11. Seller Cooperation, Access, and Restricted Inspections

Inspection quality and completeness depend on the cooperation of the Seller, dealership, property owner, Vehicle owner, and other persons controlling access. CARMEPX does not control whether a Seller provides accurate information, permits photographs, allows diagnostic scanning, authorizes a road test, provides keys, makes the Vehicle accessible, or keeps the Vehicle available.

When access is denied or materially restricted, the Report may state “Seller Refused,” “Access Denied,” “Inspection Restricted,” or similar wording. Seller refusal may be relevant to the Client’s decision, but it does not by itself prove fraud, tampering, defects, dishonesty, or illegal conduct.

12. Report Statements, Preliminary Comments, and Corrections

The final written Report controls over preliminary observations, conversations, telephone calls, text messages, emails, or verbal comments made before the Report is completed. No oral or informal statement creates a separate warranty or expands the purchased package.

The Client should review the Report promptly and report any suspected clerical error, incorrect Vehicle identification, missing image, unreadable attachment, or delivery problem within forty-eight hours and, whenever reasonably possible, before purchasing the Vehicle. CARMEPX may correct clerical mistakes, clarify language, replace missing files, amend the Report, conduct a limited reinspection, or provide another remedy allowed by the Terms of Service.

A correction or amendment does not mean that CARMEPX admits negligence, liability, or responsibility for the Vehicle or transaction.

13. Client Responsibilities and Independent Purchase Decision

The Report is one source of information. The Client alone is responsible for deciding whether to purchase, reject, negotiate for, finance, insure, transport, store, repair, or operate the Vehicle. CARMEPX is not the Client’s attorney, dealer, purchasing agent, insurer, lender, repair facility, appraiser, or fiduciary.

Before completing a purchase, the Client should independently consider:

• Title, ownership, lien, theft, odometer, accident, flood, salvage, and recall information.
• Maintenance records, repair records, Seller identity, VIN accuracy, and Seller authority.
• Insurance eligibility, financing terms, registration, taxes, emissions requirements, and legal compliance.
• Written repair estimates and additional diagnosis from an appropriate repair facility or manufacturer-authorized specialist.
• Whether the Vehicle is suitable for the Client’s intended use, including commuting, commercial use, towing, rideshare, off-road use, or long-distance travel.

The Client voluntarily assumes the ordinary risks associated with evaluating, purchasing, owning, transporting, repairing, and operating a used vehicle.

14. No Warranty, Insurance, Repair Liability, or Reimbursement

The inspection and Report are not a vehicle warranty, extended warranty, service contract, maintenance agreement, insurance policy, mechanical-breakdown policy, certification of future reliability, or guarantee against future expenses.

To the maximum extent permitted by applicable law, CARMEPX disclaims warranties and representations not expressly stated in a written agreement signed by CARMEPX. A component may fail or require repair even if no defect was observed during the inspection.

Except where non-waivable law requires otherwise, CARMEPX will not purchase, repair, replace, reimburse, or contribute toward the cost of parts, labor, diagnosis, towing, storage, transportation, rental vehicles, lodging, travel, financing, taxes, registration, lost use, diminished value, lost profits, the Vehicle purchase price, or any other vehicle-related cost. Liability limitations and available remedies are governed by the CARMEPX Vehicle Inspection Terms of Service.

15. Report Recipient, Permitted Use, and Third-Party Reliance

The Report is prepared for the paying Client and for the specific Vehicle identified in the Report. The Client receives a limited right to use the Report for the Client’s own evaluation of that Vehicle, subject to the CARMEPX Report Usage & Reliance Disclaimer and Terms of Service.

A Seller, dealer, lender, insurer, repair facility, auction, transporter, subsequent purchaser, later owner, website visitor, or other third party does not acquire contractual rights against CARMEPX merely by receiving, viewing, quoting, or discussing the Report. Third parties must not rely on an altered, incomplete, outdated, or selectively quoted Report.

The Report may not be used to:

• Represent that CARMEPX certified, guaranteed, approved, endorsed, or warranted the Vehicle.
• Advertise the Vehicle as “CARMEPX Certified” or use CARMEPX branding without written authorization.
• Remove warnings, change findings, replace photographs, alter ratings, or publish misleading excerpts.
• Resell or republish the Report as an independent commercial product without CARMEPX’s written permission.

16. Changes After the Inspection

The Report does not cover changes occurring after the inspection. CARMEPX is not responsible for later repairs, damage, accidents, transportation, storage, weather exposure, vandalism, theft, Seller activity, test drives, fluid changes, battery disconnection, diagnostic-code clearing, parts removal, parts substitution, mileage accumulation, or any other post-inspection change.

If material time passes, mileage changes, the Vehicle is repaired, warning lights appear, the Vehicle is moved, or the Client receives new information, the Client should obtain updated inspection or diagnostic information before relying on the prior Report.

17. Pilot Program and Service Improvements

CARMEPX may operate a limited pilot program and may improve its workflow, technology, inspection checklist, report format, quality-control process, scheduling system, service area, available packages, or inspector-assignment process. Pilot status does not reduce CARMEPX’s obligation to perform the purchased service with reasonable care or eliminate rights that applicable law does not permit the parties to waive.

Changes apply prospectively. The package and terms accepted for a booking govern that booking unless the Client affirmatively agrees to a change or CARMEPX provides an appropriate remedy.

18. Controlling Terms, Non-Waivable Rights, and Updates

This Disclaimer must be read together with the CARMEPX Vehicle Inspection Terms of Service, Refund Policy, Payment & Billing Policy, Privacy Policy, Service Area & Scheduling Policy, and Report Usage & Reliance Disclaimer. Those documents may provide additional rights, obligations, liability limitations, and dispute procedures.

Nothing in this Disclaimer excludes or limits a right, remedy, duty, or liability that applicable law does not allow the parties to waive. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue to apply.

CARMEPX may update this Disclaimer prospectively. The version accepted or presented at the time of booking governs that booking unless the Client affirmatively agrees to a later version. Each version will display an effective date and document version.
